Our practice in the area of commercial litigation has grown rapidly in the last several years.   We have represented a broad range of litigants in commercial disputes ranging from temporary restraining orders to permanent injunctions to traditional contract disputes of every magnitude.

Marks, O’Neill, O’Brien & Courtney has developed a significant client base as both personal/corporate counsel and local counsel in the bankruptcy arena. The firm’’s attorneys regularly represent creditors, secured and unsecured, and parties in interest in defending preference and fraudulent conveyance actions brought by debtors, defending against objections to proofs of claim, Chapter 11 Disclosure Statement approval and the Plan of Reorganization confirmation process, as well as more limited roles such as moving to lift the automatic stay.

Our IP Practice Group is engaged in a variety of intellectual property areas including patents, copyrights, trademarks, trade secret protection, unfair competition, false advertising, and defamation, publicity and privacy issues.

Beyond the litigation needs of our Health Care Services clients, we provide education, advice and counseling on best practices healthcare, human resource and employee discipline/termination through regular seminars and in-house training directed to hospital supervisors, practice groups, residents, interns, nurses and risk managers.

Our Class Action practice group has represented a variety of clients in all of the jurisdictions in which we practice including:

  • claim of PCB release at an academic institution
  • claim of widespread salmonella poisoning
  • medical monitoring claim for contaminated water supply 
  • consumer claim of fraudulent collection practices
  • insureds alleging insurer bad faith
  • complaint of consumers regarding unsolicited faxes
  • claim for property damage and medical monitoring following gasoline and benzene underground storage tank leaks
