At Marks, O’Neill, O’Brien & Courtney we have been actively involved  in the defense of employers in employment based litigation.  Specifically, we have handled matters arising under Title VII, various Federal and State Statutes such as the Americans with Disability Act, the Age Discrimination in Employment Act, and the Family Medical Leave Act.  We have seen an explosion of discrimination based claims in employment and we are prepared to aggressively mount a defense and perform the initial investigation so crucial to the defense of these claims.
 We are also active in advising our business clients of the legal ramifications of acts that they take, or attempt to take in the workplace. A cohesive representation plan pre-litigation is essential to their successful resolution.  We recognize the business realities faced by our clients and work with them to achieve business results in a manner consistent with State and Federal Law.  We focus on the needs of our clients and deliver quality legal services designed to meet those needs including representation at EEOC and State Human Rights Commissions hearings.

Relatedly, we successfully represent municipal agencies involving claims of law enforcement activity (false arrest, excessive use of force, false imprisonment, failure to provide adequate police protection) or malicious prosecution, school board disputes or First Amendment Claims.

We have significant experience in the defense of municipalities and public entities including police departments and school districts for a variety of constitutional claims.  These include civil rights claims, zoning challenges, First Amendment issues and excessive force claims.
